1. Form I-765:
The first document you need to submit is the Form I-765, Application for Employment Authorization. This is the primary form used to apply for H4 EAD.
2. Form I-539:
Along with Form I-765, you will also need to submit Form I-539, Application to Extend/Change Nonimmigrant Status. This form is used to apply for a change of status from an H4 dependent visa to an H4 EAD
3. Copy of H4 Visa:
A copy of your current H4 visa should be included in the application.
4. Copy of Passport:
A copy of the identification pages of your passport must be included in the application.
5. Copy of Marriage Certificate:
A copy of your marriage certificate must be included in the application to prove your relationship to the H1B visa holder.
6. H1B Visa Holder’s Current Employment Verification Letter:
A letter from the H1B visa holder’s current employer verifying their employment and salary must be included.
7. Proof of Financial Support:
Proof of financial support such as bank statements, tax returns, or pay stubs from the H1B visa holder must be included in the application.
8. Two Passport-Sized Photos:
Two recent passport-sized photos must be included in the application.
9. Application Fee:
The application fee must be paid online or by check or money order.
10. Optional Documents:
You may include additional documents such as employment verification letters, educational qualifications, or any other supporting documents that may strengthen your application.
